NIALS Webinar on The Role of Private Law in Africa’s Economic Integration: Issues and Perspectives.

Africa’s integration has been a key focus of the African Union’s agenda since its establishment in the 1960s. This focus cumulated in the signing of the Abuja Treaty of 1991. Nigeria like other jurisdictions has been very active in the pursuit ·of economic integration as an important aspect of her international commercial policy.

Notably, the legal framework of international trade law has a significant impact on not only the behaviour of states and their corporations but also on private actors and their conduct of economic activities. The economic integration moves within the African continent are bound to result in increased disputes involving private actors trading within and outside the continent. Such disputes, especially between non-state actors will trigger issues concerning what laws should apply; what court should have jurisdiction, and how foreign judgments would be recognised and enforced, in order to ensure that international trade flows smoothly.
